1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the OOO ,MITNAS platform, including our website at santim.space, mobile applications, and related services (collectively, the "Service"), operated by OOO ,MITNAS ("OOO ,MITNAS", "we", "us", or "our").
By creating an account, accessing, or using the Service, you ("User", "you") acknowledge that you:
- are at least 18 years of age;
- have the legal capacity to enter into a binding agreement;
- have read and understood these Terms and our Privacy Policy;
- agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Services
OOO ,MITNAS provides AI-powered personal financial assistance services, including but not limited to:
- Automated transaction categorization and budget tracking;
- Spending analysis, pattern recognition, and personalized insights;
- Cash-flow forecasting and savings goal management;
- AI-generated financial recommendations and planning suggestions;
- Integration with authorized financial institution accounts via read-only API connections.
The Service is provided for informational and personal financial management purposes only. OOO ,MITNAS is not a licensed bank, investment advisor, broker, or financial institution. Nothing in the Service constitutes financial, investment, tax, or legal advice.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible. We are not liable for any service interruptions.
3. User Accounts
To access the Service, you must create an account. By doing so, you agree to:
- Provide accurate, current, and complete information during registration;
- Maintain the accuracy of your account information;
- Keep your login credentials confidential and not share them with third parties;
- Notify us immediately at yona@santim.space if you suspect unauthorized access to your account;
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that contain false information, are used in violation of these Terms, or are inactive for more than 24 consecutive months. Upon termination, your access to the Service ceases, but data retention obligations under applicable law continue as outlined in our Privacy Policy.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Service for any illegal purpose or in violation of Russian federal law or applicable international regulations;
- Attempt to gain unauthorized access to other user accounts, our systems, or infrastructure;
- Reverse engineer, decompile, disassemble, or otherwise attempt to extract source code from the Service;
- Transmit viruses, malware, or any other harmful code via the Service;
- Use automated means (bots, scrapers, crawlers) to access or extract data from the Service;
- Misrepresent your identity or impersonate another person;
- Use the Service in any way that could impair its performance or availability for other users;
- Attempt to probe, scan, or test vulnerabilities in our systems without prior written authorization.
Violation of these restrictions may result in immediate account termination, and we reserve the right to report violations to appropriate authorities.
5. Intellectual Property
All content, software, technology, and materials comprising or contained within the Service — including but not limited to the OOO ,MITNAS name and logo, AI models, algorithms, interface design, text, graphics, and data compilations — are the exclusive intellectual property of OOO ,MITNAS and are protected by Russian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial financial management purposes.
You do not acquire any ownership rights by using the Service. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.
With respect to data you input or connect to the Service, you retain ownership of your personal financial data. You grant OOO ,MITNAS a limited license to process your data solely to deliver the Service to you, as described in our Privacy Policy.
6. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Any warranty that the Service will be uninterrupted, error-free, or free of viruses or harmful components;
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of financial information, AI recommendations, or forecasts provided through the Service.
AI-generated financial insights and recommendations are based on patterns in your data and do not constitute professional financial advice. You should consult a qualified financial professional before making significant financial decisions.
We are not responsible for the accuracy of data provided by third-party banking systems or other external data sources connected to the Service.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OOO ,MITNAS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, business opportunities, or goodwill;
- Financial losses arising from reliance on AI recommendations or forecasts;
- Unauthorized access to or alteration of your data;
- Any matter beyond our reasonable control.
In any case, our total aggregate liability to you for any claims arising from or related to your use of the Service shall not exceed the total fees paid by you to OOO ,MITNAS in the twelve (12) months preceding the event giving rise to the claim, or 1,000 RUB, whichever is greater.
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
8. Governing Law
These Terms and any dispute arising from your use of the Service shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law principles.
Any disputes that cannot be resolved amicably shall be submitted to the competent courts of the Russian Federation at the place of registration of OOO ,MITNAS, unless otherwise required by applicable consumer protection law.
Before initiating legal proceedings, you agree to first attempt to resolve any dispute by contacting us at yona@santim.space with a written description of your claim. We will make reasonable efforts to resolve the matter within 30 days.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
